Louisiana adds its own rules on top of the federal FCRA. First, La. R.S. 23:291.2 bars using arrests that did not lead to a conviction. Second, you must assess each conviction against the job’s duties.

The FCRA also applies to every report. Before ordering, give a standalone disclosure and get written authorization. Then follow the pre-adverse and adverse action steps in the FTC employer guide.

Also, watch for Article 894 pleas like the sample above. A court may later set aside the conviction and allow expungement. Once expunged, Louisiana records leave public view under C.Cr.P. Article 973.
