Employment Screening Laws in Utah

Utah is a one-of-a-kind scenario, simply because their employment screening laws forbid companies from directly getting criminal records on their potential job applicants or current employees. Businesses can order FBI background checks, but cannot directly obtain state or county criminal searches. The exception to this law are: child & adult care agencies, financial services organizations and companies providing staffing to national security (i.e., defense contractors, etc.)
However, employers in Utah are technically allowed to inquire about arrest records.

In other words, prospective employees must initiate and obtain their own criminal background check and deliver our report to their potential employers. To protect the report’s integrity from any tampering, they can sign a release form to have us send the Utah criminal background check directly to their employer. We can accommodate that demand by having the employer send a background check request link directly from within their own account in order for your applicant to self-screen and pay us directly. Once the criminal history report is completed, it is securely uploaded to your account as well as a copy sent to your applicant. During this process, the applicant will electronically sign all FCRA forms.

Utah House Bill 156 prohibits public sector employers from requiring an applicant to disclose conviction history before an initial interview or, if no interview is conducted, before a conditional job offer. The law provides for exceptions for situations where a law requires consideration of the applicant’s conviction history as well as for law enforcement, criminal justice, tax commission, or alcoholic beverage control employers, as well as for applicants that will work with children or vulnerable adults and nonemployee volunteers.

There is no Ban-the-Box policy in effect for private employers, yet.

Remember that an employer must always consider EEOC guidance when making a hiring decision. The Equal Employment Opportunity Commission (EEOC) calls for companies to conduct an Individualized Assessment based on the nature of the offense and how it relates to the job position prior to automatically disqualifying an employment applicant based on their past criminal records history.

When determining whether a criminal offense would disqualify a potential employment candidate, employers must give consideration to:

  1. The nature and gravity of the criminal offense
  2. How much time has passed since the offense or sentence
  3. The nature of the job (including where it is performed, how much supervision and interaction with others the employee will have, etc.)

The EEOC has stated that employers ought to give job seekers with a criminal record the opportunity to explain the circumstances and provide mitigating information showing that the employee should not be excluded based on the nature of the offense.
