Oregon Laws That Shape Criminal Screening

Oregon adds several state and local rules on top of the federal FCRA.

Below, we explain the four that matter most for a criminal search.

Oregon Ban-the-Box Law (ORS 659A.360)

Under ORS 659A.360, employers may not screen out applicants from an initial interview over a past conviction.

So, you cannot ask about convictions on the application or before that first interview.

Without an interview, you must wait until a conditional job offer.

The Oregon Bureau of Labor and Industries (BOLI) enforces the law.

Law enforcement, criminal justice employers and volunteer roles are exempt.

Portland Fair Chance Ordinance (City Code 23.10)

Portland goes further for employers with six or more employees.

Under City Code 23.10.030, you must make a conditional offer before you check criminal history.

After that, you must weigh the offense, the time elapsed and the job itself.

You also may not consider arrests without a conviction, expunged convictions or completed diversions.

If you rescind an offer, you must name the convictions in writing.

Set-Aside Records (ORS 137.225)

Oregon lets people ask a court to set aside eligible arrests and convictions.

Once a court grants it, the person counts as never convicted of that offense.

Waiting periods run from one year for minor misdemeanors to seven years for Class B felonies.

For that reason, our researchers exclude set-aside cases from every report.

Expunged Juvenile Records (ORS 659A.030)
