What It Is

What Is a Nebraska Statewide Criminal Background Check?

A Nebraska statewide criminal background check searches the state’s trial court records by name and date of birth.

Nebraska places a county court and a district court in every county.

Consequently, one statewide search reaches both courts in all 93 counties at once.

Our search pulls felony, misdemeanor, and traffic cases filed in those courts.

Each record then shows the file date, the disposition, and the complete sentence.

Employers, landlords, and staffing firms use it to screen Nebraska applicants quickly.

Before you order, review the Nebraska background screening laws that shape how you can use each record.

Court Coverage

How Nebraska Courts Store Criminal Records

Nebraska runs a unified trial court system that the state’s JUSTICE case management system tracks.

Meanwhile, the Judicial Branch updates that case listing every night.

County Courts

County courts hear misdemeanors, traffic citations, and infractions.

They also hold felony cases until a preliminary hearing sends them upward.

District Courts

District courts try felony cases and hear appeals from county courts.

Twelve judicial districts cover the entire state.

Nightly Updates

New filings appear within about 24 hours of court entry.

As a result, your report reflects recent charges, not stale data.

Court Search vs. Nebraska State Patrol Repository

Many employers assume the Nebraska State Patrol report covers everything.

However, the state repository only lists arrests where police took fingerprints.

In fact, the state’s own portal says citation cases and minor traffic violations stay out of it.

A court-based search fills that gap, because every charge filed in a trial court appears.

Compliance

Nebraska Laws That Affect How You Use Results

Nebraska adds a few rules on top of the federal FCRA.

Above all, you must follow them before you act on any record.

Sealed Records, Neb. Rev. Stat. § 29-3523

Nebraska seals arrests with no charges after one year.

Likewise, it seals completed diversions after two years and dismissals right away.

Employers may not ask about sealed records, according to § 29-3523.

Ban-the-Box, Neb. Rev. Stat. § 48-202

Public employers must wait until an applicant meets minimum qualifications.

Only then can they ask about criminal history, under § 48-202.

Private employers, by contrast, face no state ban-the-box rule.

Set-Aside Convictions, § 29-2264

A court can set aside certain convictions after the sentence ends.

Still, a set-aside nullifies the conviction but does not seal the court file.

Federal FCRA Seven-Year Rule

The FCRA limits non-conviction records to seven years.

Convictions, however, have no federal time limit in Nebraska.

For every statute, agency, and lookback detail, read our full Nebraska employment screening laws guide.
