Why the Highway Patrol name search leaves gaps

What Missouri law lets employers use
Missouri draws a firm line between open and closed records. Understanding that line keeps your hiring decisions defensible.
Closed records stay out of your report
RSMo 610.105 closes the official record once a case finally terminates. That rule covers an acquittal, a dismissal, a nolle prosequi and a completed suspended imposition of sentence. RSMo 610.120 then limits access to criminal justice agencies and a short list of licensing bodies. Private employers are not on that list. Consequently, we do not report closed Missouri records.
Expunged records carry a statutory answer
RSMo 610.140 lets a court expunge eligible offenses after a one-year wait for misdemeanors and a three-year wait for felonies. Afterwards, the applicant may lawfully answer “no” to questions about that arrest or conviction. Certain federally regulated roles are excepted, and lifetime limits cap the relief at two felonies and three misdemeanors.
Pending cases are reportable, but handle them carefully
A pending Missouri charge remains an open record, so it appears on your report. Nevertheless, a filing is not a finding of guilt. Use the EEOC’s individualized assessment, document the job relationship and follow the FCRA adverse action sequence before you decide.
