Employment Screening Laws in North Carolina

The State of North Carolina employs the recommended rules and regulations standard policies of the hiring guidelines established by the Fair Credit Report Act (FCRA).

  2. Send FCRA Pre Adverse Action Letter. Wait at least five days to allow the applicant to dispute any discrepancies before taking any further action
  3. If by then, a decision has been made to not to hire the applicant based on the applicant’s response and further investigation of records found — a job declination FCRA adverse action letter must be sent

North Carolina law allows someone whose arrest, charge, or conviction was expunged to omit that expunged entry in response to questions. Employers are also prohibited from asking applicants about expunged criminal history.

All private and most public employers in North Carolina are permitted to inquire about an applicant’s criminal history, including arrest and conviction records. If employers choose to consider arrest records, they must use caution to remain within the non-discrimination boundaries outlined in Title VII of the Civil Rights Act and the FCRA. Disqualifications “for cause” based on conviction records should consider the relevancy of the charges to a job position.

North Carolina also limits the extent to which state licensing boards may consider criminal records in granting or denying licenses to practice a particular occupation or profession. If a board is authorized to deny a license based on the applicant’s commission of a crime involving fraud or moral turpitude, the board must consider these factors in reaching its decision:

the level and seriousness of the crime
when the crime occurred
the applicant’s age when the crime was committed
the circumstances of the crime
the relationship between the crime and the profession or occupation the applicant seeks to practice
prison, parole, rehabilitation, and employment records since the crime
any subsequent criminal activity, and
any affidavits or other written documents, including character references.

No statewide policy for private employers, only for the public sector.

Remember that an employer must always consider EEOC guidance when making a hiring decision. The Equal Employment Opportunity Commission (EEOC) calls for companies to conduct an Individualized Assessment based on the nature of the offense and how it relates to the job position prior to automatically disqualifying an employment applicant based on their past criminal records history.

When determining whether a criminal offense would disqualify a potential employment candidate, employers must give consideration to:

  1. The nature and gravity of the criminal offense
  2. How much time has passed since the offense or sentence
  3. The nature of the job (including where it is performed, how much supervision and interaction with others the employee will have, etc.)

The EEOC has stated that employers ought to give job seekers with a criminal record the opportunity to explain the circumstances and provide mitigating information showing that the employee should not be excluded based on the nature of the offense.
