Employment Screening Laws in Florida

Florida offers companies with a substantive incentive to perform comprehensive background screening on employment candidates. For instance, if an employer demonstrates that a due-diligence criminal background check did not find any derogatory records at the time of hiring, the employer is insulated from a negligent hiring lawsuit in the unfortunate event that the employee were to commit an act of violence in the workplace.
This incentive is pretty much like buying very inexpensive insurance when you factor the cost of a background check versus legal fees and reputation damage to an employer.

As long as the employer conducted such a check, and it didn’t uncover any information reasonably demonstrating that the employee was unfit for the job (or unfit for employment in general), the employer is entitled to a presumption that it did not act negligently.

The State of Florida employs the recommended rules and regulations standard policies of the hiring guidelines established by the Fair Credit Report Act (FCRA).

  • Background check consent must be completed and signed in a separate stand-alone form separate from employment application as per FCRA. Must be clear and conspicuous to their knowledge
  • Establish an HR policy when conducting employment background checks for each job position. For example, what past criminal offenses are to be considered in relation to the job position

If derogatory records are found:

  1. If doing a nationwide criminal database search, verify that any database records found are updated and accurate at originating source (i.e, County Criminal Court and/or Real-Time State Criminal search
  2. Send FCRA Pre Adverse Action Letter. Wait at least five days to allow the applicant to dispute any discrepancies before taking any further action
  3. If by then, a decision has been made to not to hire the applicant based on the applicant’s response and further investigation of records found — a job declination FCRA adverse action letter must be sent

The State of Florida has not yet passed Ban-the-Box laws on a statewide basis.
However, there are counties and municipalities that have embraced Ban-the-Box laws thereby implementing public sector employment laws towards inquiring about past criminal records in their employment applications.
Public Sector jobs: Clearwater, Daytona Beach, Gainesville, Fort Myers, Jacksonville, Miami-Dade, Orlando, Pompano Beach, Sarasota, St. Petersburg, Tampa, and Tallahassee.
Private sector jobs: No cities or counties have implemented Ban-the-Box.

There are several restrictions in Florida at the state level and in individual counties that limit the use of background checks for employment purposes.
Arrest Records
Employers in Florida are legally permitted to inquire about arrest records.
Sealed or Expunged Records
Employment applicants are generally not forced to divulge arrest or conviction data that have been sealed or expunged.
Criminal Records
Public and private sector employers are permitted to use Florida background checks to screen employees. Public sector employers are only allowed to disqualify candidates for a felony or first-degree misdemeanor convictions, and only if the crime in question relates directly to the job position. Private-sector employers can consider all conviction history information in their hiring decisions.
Tip: Employers need to further give consideration to the aspect of criminal convictions and their relation to the job position. Employers that automatically disqualify candidates with any past criminal records will get exposed to a significant risk of an employment discrimination prosecution under Title VII of the Civil Rights Act of 1964 which can vigorously be pursued by the EEOC.

Remember that an employer must always consider EEOC guidance when making a hiring decision. The Equal Employment Opportunity Commission (EEOC) calls for companies to conduct an Individualized Assessment based on the nature of the offense and how it relates to the job position prior to automatically disqualifying an employment applicant based on their past criminal records history.

When determining whether a criminal offense would disqualify a potential employment candidate, employers must give consideration to:

  1. The nature and gravity of the criminal offense
  2. How much time has passed since the offense or sentence
  3. The nature of the job (including where it is performed, how much supervision and interaction with others the employee will have, etc.)

The EEOC has stated that employers ought to give job seekers with a criminal record the opportunity to explain the circumstances and provide mitigating information showing that the employee should not be excluded based on the nature of the offense.

The funds collected when FDLE provides criminal history information to the public are allocated by the Legislature to support criminal information systems for use by law enforcement throughout the state.
Why did my FDLE search return no results?
Reasons why this may occur are as follows:
  • Subject has never been arrested or fingerprinted for a serious offense in Florida
  • Subject’s Florida record is sealed or expunged
  • Subject’s criminal fingerprint card was sent to FDLE but it contained a major error, has not been received by FDLE or not yet entered into repository
  • Arresting agency never submitted criminal fingerprint card to FDLE
  • Subject’s criminal fingerprint card was sent to the FBI but not to FDLE (Arrests prior to 1983, two fingerprint cards were supposed to be submitted from local criminal justice agencies; one to the FBI and the other to FDLE)
  • Subject was taken into custody as a juvenile for an offense that would be a misdemeanor if committed by an adult
  • Subject was arrested by a Federal agency or in a state other than Florida (NCIC rules do not allow dissemination of national or other state criminal history information for public record/non-criminal justice purposes)
